RELEASE AND WAIVER OF LIABILITY AGREEMENT

 

READ THIS AGREEMENT CAREFULLY BEFORE ACCEPTING THE TERMS. CHECKING THE “I HAVE READ AND AGREE” BOX INDICATES THAT YOU UNDERSTAND THIS AGREEMENT AND AGREE TO ITS TERMS. BY AGREEING, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR RECOVER DAMAGES IN CASE OF INJURY FOR ANY REASON, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE CHARISMATIC VOICE, LLC (“TCV”) AND ITS OWNERS, EMPLOYEES, AND AGENTS (TOGETHER, “RELEASEES”).

 

TCV offers individuals the opportunity to participate in voice lessons and vocal training courses (the “Activity”) to assist in building participants’ singing abilities.

 

In consideration for allowing me to participate in the Activity, and on behalf of myself and my dependents, personal representatives, heirs, next-of-kin, spouses, and assigns, I HEREBY:

 

  1. Acknowledge that I have familiarized myself with the Activity that I will be participating in and understand the potential dangers and inherent risks that I could incur by participating in the Activity. This may include but is not limited to vocal fold strain, hemorrhaging, development of vocal nodules, and dysphonia.

 

  1. Agree to comply with all policies and rules of TCV, including but not limited to rules and practices regarding vocal warm-ups and exercises. I further agree to conduct myself in a safe manner.

 

  1. Agree that I am physically capable of participating in the Activity and do not suffer from any health condition or medical issue that may be aggravated or otherwise cause a danger to myself by such participation.

 

  1. Voluntarily assume all risk and danger of injury or death from any cause whatsoever, including but not limited to injury or death caused by (i) participation in the Activity, or (ii) the negligence of any of Releasees or any other participant in the Activity.

 

  1. RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Releasees for any loss, liability, damages, or cost whatsoever arising out of or related to any loss, damage, or injury (including death) to my person or property (each an “Injury”) arising out of, during, or in connection with the Activity, and I hereby waive all claims in respect thereof against Releasees. Such release will not apply to an Injury resulting solely from the gross negligence or willful, wanton, or intentional acts or omissions of TCV.

 

  1. Agree that the foregoing Release is governed by the laws of the State of Arizona and is intended to be as broad and inclusive as permitted by Arizona law, and that in the event any portion of this Agreement is determined to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the rest of the Agreement will not be affected or impaired in any way and will continue in full legal force and effect.

 

I have read this entire Release of Liability Document. I understand it is a promise not to sue and to release TCV and its owners, employees, and agents for all claims. I have made a free and deliberate choice to agree to this Release and Waiver as a condition to Releasees allowing me to participate in the Activity. I have concluded the risks involved and the release and waiver of liability is worth the benefits of such participation.
